On January 15, 2024, the Panel 4 of the High Qualification Commission of Judges of Ukraine (Vitalii Gatseliuk, Oleh Koliush, Ruslan Melnyk), at its meeting, considered the issue of submitting a motion to the High Council of Justice to dismiss a judge of the Henicheskyi Raion Court of Kherson Oblast Yulia Berlimova from the position held.
On December 14, 2023, the Commission recognized the judge Yulia Berlimova as such who refused to pass the qualification evaluation for correspondence to the position held.
According to the Law of Ukraine “On the Judiciary and the Status of Judges”, a judge’s refusal to pass a qualification evaluation shall be grounds for dismissal from office.
Pursuant to paragraph 16-1 of Section XV “Transitional Provisions” of the Constitution of Ukraine, the compliance with the position of a judge appointed for a five-year term or selected as a judge for an unlimited term before the entry into force of the Law of Ukraine “On Amendments to the Constitution of Ukraine (regarding justice)” must be evaluated in accordance with the procedure established by law. If the results of such evaluation indicate that the judge does not correspond to the position held by the criteria of competence, professional ethics or integrity, or if the judge refuses to pass such evaluation, this shall be grounds for dismissal of the judge from office.
Commission decided to submit motion to the High Council of Justice to dismiss a judge of Henicheskyi Raion Court of Kherson Oblast Yulia Berlimova from the position held.
